Because Ian Dustin's bankruptcy had been annulled and his liability to contribute was thereby revived, and because equitable principle and rule 4.56 favour joinder of all guarantors so contribution claims are resolved together, the Court exercised its discretion to order joinder of Dustin; lateness in discovering the annulment was shared by the parties and did not bar joinder, and joinder necessitated vacating the fixture and further case management directions.
