Because both implant and bridge were generally accepted treatments but the implant offered materially greater longevity (>15 years versus ~5 years for the bridge), the implant was held to be the treatment that would restore the claimant's health to the maximum extent practicable and therefore was necessary and appropriate under Clause 2 of Schedule 1; ACC liable to fund the implant.

The Corporation conducted adequate consultation and assessment; the appellant conveyed a decision not to pursue further rehabilitation after being advised of options including supplementary part-time work; the Corporation did not abdicate its statutory duty and was entitled to regard the rehabilitation plan as complete and proceed to a work capacity assessment, so the appeal is dismissed.

The respondent was obliged to consider all relevant evidence, not only a single occupational therapist report, and the foldaway ironing board and corner pantry were cost‑effective and necessary modifications; accordingly the appeal is allowed and the respondent must contribute a total of NZD 8,000 toward the kitchen modifications including moving the wall and providing the foldaway ironing board.
