The defendants executed and are bound by the settlement agreement, breached it by failing to pay the agreed $40,000 by the due date, and therefore plaintiffs are entitled to judgment for $40,000 plus interest at the contractually agreed rate of 10% per annum from 1 April 2020 and to solicitor and client costs for enforcement.

The plaintiff proved publication of defamatory statements as pleaded in paragraphs [8](b) and (c); a declaration of liability under s 24(1) Defamation Act 1992 was made and solicitor and client costs with disbursements were ordered under s 24(2); the English translation was accepted as accurate on evidence from a qualified translator.

Defendants defaulted under the loan and mortgage; valid s92 notices (preserved by s127(2) 2007 Act) accelerated the debt and entitled the mortgagee to possession; substituted service was adequate; therefore summary judgment for possession and for the debt (with contractual interest and solicitor-and-client costs) was warranted.
