Special leave to extend time to appeal the District Court costs decision was refused because the delay was substantial, prejudice to the respondent was clear, and the proposed appeal had extremely slim merits given Judge Crosbie's finding of exceptional circumstances under s45(3) and the appellant's eleventh hour abandonment of the substantive appeal.
