The plaintiff's costs application is dismissed because the Newton principle applies to judicial institutions; the District Court Judge's failure to give reasons did not constitute conduct so perverse, oppressive or in bad faith as to justify costs against the Court, and it was not appropriate to transfer that obligation to the Crown where the Crown did not oppose the review and the plaintiff could have sought reconsideration in the District Court.
