Leave to appeal was refused because, although arguable questions of law were raised about the ambit of s 129, the repeal and replacement by the Property Law Act 2007 reduced the public importance and practical utility of a successful challenge and the matters were fact driven; consequently the issues did not involve sufficient public or private importance to justify the delay, cost and court resources of a further appeal.
