The Court exercised its discretion to award EQC costs against the plaintiffs and their funder CRSL on a 2B basis (with an allowance recognizing additional preparation due to late expert evidence) and to order joint and several liability of the Sadats and CRSL for costs and disbursements; however, the Court declined to make personal costs orders against the expert witnesses, balancing the need to enforce expert duties with not deterring expert participation.
