The Court dismissed the appeal: the trial judge did not misapply his discretion. Viewing the litigation in totality appellant was the unsuccessful party, its conduct was intransigent and intended to obtain access to the hangar, increased costs were justified, and a global percentage reduction for respondent's partially unsuccessful counter-claim was appropriate given the short trial.
