Applying the District Court Rules 2009 and the guidance in P v ACC, the Judge accepted the respondent's allocations for preparation and reduced attendance time to a quarter day; therefore the appropriate 2B scale award is $2,945 payable by the respondent to the appellant.

The proceedings were struck out because the plaintiffs failed to comply with a prior security for costs order, have taken no steps since that order, cannot instruct counsel or meet the security requirement, and therefore there is no reasonable prospect of the case proceeding; leave to withdraw counsel was granted and costs were awarded to defendants on a 2B basis.
