The costs award of 13 February 2013 was quashed because the Associate Judge failed to assess whether the additional documents in the later affidavit fell within the specific categories ordered by Clifford J (notably the accounting and tax records), and therefore did not properly establish non-compliance sufficient to justify the costs award; the 12 November 2012 costs order remains and outstanding memoranda on costs are to be forwarded to Clifford J.
