Given that the substantive issue concerned the welfare of a person under 16, the High Court properly exercised its discretion under s 13(2)–(3) of the Habeas Corpus Act 2001 to transfer the habeas corpus application to the Family Court to be dealt with under the Care of Children Act 2004 because the child's chronic and urgent welfare issues required Family Court processes including a judicial settlement conference.
