The court held that s.88(2) contemplates regulatory permission for overseas treatment costs but the relevant counselling regulations can be given contextual meanings to encompass a suitably qualified overseas psychiatrist/counsellor and an emergency method of referral; on the facts Dr Anzai and the referral method met that contextual meaning and the Appeal Authority's finding of special circumstances supports payment, so the Corporation's decision was revoked and the appeal allowed with payment ordered for costs from 1 July 1992 calculated under the regulations.
