Leave to appeal was dismissed because, although the statutory interpretation of s 45 raises issues of general importance, the Supreme Court should allow the Court of Appeal to consider those issues first; the applicant should seek leave to appeal to the Court of Appeal and take account of the recent R v Thomson-Wiari decision.
