The Court reappointed Sir Edward Durie because he demonstrably met the qualities required for trusteeship, reappointment preserved valuable experience and continuity without creating contemporaneous trustee expiries, the Trust had been functioning effectively since prior appointments reducing the risk of renewed deadlock, and there was no constructive purpose in denying reappointment to express disapproval of prior litigation conduct; accordingly, exercising its powers under the Trustee Act 1956 the Court ordered reappointment with a proviso permitting agreed substitution.
