Because the defendant ceased making contributions, did not engage with proceedings and the plaintiff would suffer continuing hardship and be locked into dysfunctional co-ownership, the Court exercised its discretion under ss339 and 342 to order that the plaintiff buy the defendant's half-share at a fair price fixed at $510,000 and directed the method of distribution and payment of costs to the plaintiff.
