Brown v Accident Compensation Corporation

- District Court
The appellant failed to prove on the balance of probabilities that the labral tear was caused by the 1 February 2008 accident because there was no contemporaneous medical evidence of a hip injury at that time, credible alternative causes (pre-existing Cam impingement or gradual degeneration) existed, and the medical evidence did not exclude those alternatives; therefore causation was not established and cover under s20 was not proved.
