High Court refused special leave on the question whether Bartels applies to s58 deemed decisions (holding s65(1) requires an actual decision and Bartels does not apply to deemed decisions), but granted special leave to appeal on two issues: whether the District Court misconstrued or misapplied the causation test in relation to the s20(2)(h) treatment claim and whether the District Court erred by omitting to rule on the s20(2)(g) injury-consequential infection claim, because those issues raise serious questions of law and principle warranting further appellate inquiry.
