The Court has power under s 34 (and s 35 as illustrative) to order immediate sale where necessary to prevent defeat of restraining orders or to preserve net realisation and where the asset is no longer needed for legitimate purposes; here the quad bike was being sold in a manner that could defeat restraint, was not required for farming and was of low/depreciating value, so immediate sale with proceeds held by the Official Assignee was appropriate.
