Although Judge Cadenhead's factual findings that ACC had all necessary information by 18 July 2003 were acceptable, the legal question whether 'calculate' differs materially from 'calculate and make' and which Act governs interest is arguable; accordingly leave to appeal to the High Court is granted to determine that legal issue.
