The application to remove the proceeding to the High Court under s 89 is granted because, notwithstanding the applicants' earlier acceptance of District Court jurisdiction and a prior refusal by a District Court judge, the interests of justice require removal: the case involves legal and evidential complexity, the amount in issue far exceeds the District Court limit and discontinuance would likely render certain pleaded claims time‑barred; transfer is therefore desirable subject to costs conditions.
