The statutory wording of clause 63(b) of Part 4 of Schedule 1 requires the independence allowance to run from the date the claim for cover was lodged (18 December 2001); ACC has no discretion to backdate the allowance to an earlier date such as July 1992, therefore the appeal is dismissed.
