Leave to appeal was granted because there exists a serious and arguable question of law about whether ACC made a reviewable decision concerning entitlement to weekly compensation and whether s133(5) precludes criminal reparation orders determining entitlements that are otherwise reviewable under the Act; prior High Court obiter in Sinclair supported that a serious issue exists and the present matter is not moot, warranting leave.
