The parties consented to a declaration that the third defendant breached his fiduciary duty by transferring the assets of Power Dekor Flooring Limited to Power Dekor Limited; applying the principles in Regal (Hastings) and Latimer, the court entered consent orders awarding the plaintiff $100,000 and costs of $8,000 against the third defendant as appropriate relief under s 174 and equitable principles.
