On rehearing the High Court accepted the Family Court's factual findings and expert assessment that the mother has a personality disorder with damaged parenting capacities, a pattern of poor parenting, inconsistent engagement with services and a history of domestic violence/alcohol that together create a real risk to the children's welfare; those findings support a declaration under s14(1) and the appeal is dismissed.
