The will dated 23 June 2017 was declared valid under s14 of the Wills Act 2007 because it expressed the deceased's testamentary intentions and the circumstances (including beneficiaries' consent and the facts of signing and subsequent witnessing) justified validation despite the witnesses not being present together.

The original document dated 20 August 2008 was declared the valid will because the evidence established that the deceased intended it as his will and it reflected his testamentary intentions, and because the persons who would be affected by intestacy were aware of and did not oppose the application, permitting a without‑notice determination under the High Court Rules and relief under s14 of the Wills Act 2007 for non‑compliance with s11.

The 30 September 2008 document is a codicil within the definition of will and, although it did not comply with s 11 formalities, the Court had power under s 14 to declare it valid because it plainly expressed the deceased's testamentary intentions; s 15 did not apply to this separate codicil, and the application could be heard without notice under r 7.46.
