The assessor's 14% whole person impairment for the shoulder was lawfully and properly determined under the AMA Guides and not shown to be flawed; the 5% prior lump sum payment related to a separate knee injury and therefore could not lawfully be deducted under s442(2)(a); accordingly the respondent's decision to deduct 5% and refuse an independence allowance was quashed and the appellant is entitled to an independence allowance based on 14% from the application date.
