Because an authorised assessor certified the 50% whole person impairment using the AMA Guides (4th Ed) and that assessment was confirmed on review by the Branch Medical Advisor, the Court must accept the assessment; after deducting prior lump sum awards totalling 80% the appellant has no entitlement to an Independence Allowance, and the appellant produced no cogent specialist evidence to impugn the assessment.
