The application for an extension of time was declined because the applicant failed to provide an acceptable explanation for the prolonged delay, the proposed appeal was not genuinely arguable (being a repeated attempt to relitigate matters already determined), and granting an extension would unfairly prejudice the respondents; accordingly the discretionary relief was refused.
