The District Court erred in relying on the Anderson/Parbhu materials and the respondent's failure to seek Tribunal costs when reducing the award by 40%. A 2B scale assessment was appropriate given the preparation required; however CRC's responsible decision to abide the appeal justified a modest reduction. A 15% reduction from the 2B scale ($3,687.50) was appropriate, producing $3,134.38 for the District Court appeal; appeal costs were fixed at $3,902.50 with disbursements $580.00. The District Court order awarding $2,212.50 was set aside and replaced accordingly.
