The 3 July 2014 email was not a "decision" as defined in s6 but an administrative calculation consequent on the November 2002 decision; therefore no deemed decision arose from s146(1)(a) non-compliance and there is no basis for review or High Court appeal, so leave is dismissed.

The 3 December 2013 email and attached memorandum did not constitute a decision under s6 nor a revision under s65 because ACC did not accept the earlier decision was made in error and the communication only confirmed prior determinations on the same subject (rate of compensation); therefore no reviewable decision existed and the application for leave to appeal was dismissed.

The 3 July 2014 communication was an arithmetic/bookkeeping clarification, not a s6 'decision'; therefore no compliant review/decision existed that could give rise to a deemed decision under s137/s146, the appellant failed to demonstrate any calculation error, and the appeal is dismissed.
