Leave to appeal was declined because the appeal lacked merit: the 1998 Act did not preserve or create an entitlement to attendant care for periods prior to its commencement on 1 July 1999 and, absent an authorising transitional provision, the presumption against retrospectivity prevents backdating; additionally the appellant failed to satisfactorily explain the nearly three-year delay in filing the appeal.
