Because the litigation flowed from the state in which the deceased left his affairs (a handwritten suicide note and recorded message) and testamentary capacity was a legitimate issue, the court exercised the probate exception and ordered costs of $10,000 to be paid from the estate to the second and third defendants, but reduced the amount for delay under High Court Rules r14.7(g).
