The Court declined to strike out the judicial review proceeding: the applicant's delay was not proved to be inordinate or inexcusable on balance, the respondent failed to establish serious prejudice from the delay, and the matter was not moot because the applicant retained a continuing interest and potential utility in a substantive ruling; accordingly the strike out application was dismissed and stood adjourned for nine months with directions for timetabling including a deadline for any application for leave to administer interrogatories.
