Security for costs was ordered because plaintiff is impecunious but can provide non-cash security by way of a registrable mortgage protected by caveat; access to justice is not defeated by allowing mortgage/caveat security and the defendants were justified in applying given the loss of the litigation funder and the risk of erosion of plaintiff's equity; the court ordered $20,000 security to each defendant, to be provided by 4.00 pm 18 December 2017, and provided for an immediate stay and vacating of trial if security not furnished.
