The reviewer was wrong to decline jurisdiction because the 17 July 2009 letter did not constitute a valid s65 revision nor a fresh decision on different subject matter; accordingly the review decision in Review 146262 is quashed and the matter is remitted for a review hearing while the appeal regarding Review 139708 is dismissed.

The Court lacks power to substitute a primary decision on lump sum entitlement; appeals under s149 are confined to review decisions; the Reviewer properly directed a fresh mental injury impairment assessment given the circumstances, so the appeal is dismissed.

Care Advantage acted reasonably in deferring a decision on the Training for Independence programme pending competent specialist assessment; the delay was caused by a stalemate and insufficient information rather than unreasonable conduct by Care Advantage; the 23 July 2010 letter was administrative and not a reviewable decision; therefore the appeals are dismissed.

Delay was not unreasonable because it was attributable to the appellant's failure to provide necessary medical and employment information; the appellant must supply that information and the respondent must proceed to determine and pay entitlement on any periods that can be established without requiring all historical records.
