There is a serious question to be tried whether r94 (final approval of nominations by the Board) is incompatible with the participatory requirement in s71 of the Electoral Act 1993; the prior judgment was recalled for failure to consider s71 and an interim injunction restraining the final selection process was granted conditionally pending determination of the substantive proceeding.
