The appeal was dismissed because the evidence showed the hyperplasia either pre-existed Dr Simpson's treatment or, if it arose later, the appellant failed to establish a direct causal link to the treatment; further, hyperplasia was found to be an ordinary consequence of wearing dentures and thus excluded from ACC cover under ss 32-33.
