On the balance of probabilities the Court was not satisfied that the applicant was suffering a major depressive episode causing cognitive impairment at the time he entered his guilty pleas; the retrospective psychiatric opinion and sparse contemporaneous notes were insufficient to establish incapacity or a miscarriage of justice, therefore the application to set aside the pleas is declined.
