On rehearing the Court upheld the Tribunal's factual finding that the record entries did not prove an actual diagnosis of gastritis, accepted that documentation failings amounted to misconduct but were not alone sufficient to justify further sanction, found the Tribunal properly considered fitness to practise and prior history in imposing strict conditions rather than suspension, and dismissed both the Director's appeal and the practitioner's cross-appeal.
