The Court held that the existence and validity of the Agreement had not been previously finally determined; the evidence was equivocal and the earlier judge expressly left valuation issues for later determination; accordingly the defendant was not estopped or precluded from challenging the Agreement and the plaintiff's application to compel the valuer to proceed on that basis and to stay the challenge was dismissed.
