The failure to comply with the Standards Committee's statutory s147(2)(a) direction and repeated non-engagement constituted unsatisfactory conduct; unsatisfactory conduct does not require wilfulness or recklessness, and the appellant's unproven, self‑reported ill health mitigated but did not excuse liability or the imposition of censure, a $5,000 fine and costs.

The High Court held that under s95(2) HPCAA the Tribunal erred by underweighting unchallenged evidence that publication would harm vulnerable former patients and by insufficiently weighing exceptional family stress; those private interest factors clearly outweighed the public interest in disclosure and made permanent non‑publication 'desirable', so a permanent order prohibiting publication of the appellant's name and identifying particulars was made.

High Court upheld the Tribunal's factual findings that Gibson failed to complete prepaid dental treatments, kept inadequate records and that those acts/omissions fell within s54(1)(b); dismissed Gibson's substantive appeals.
