Applicant was not a person suffering loss or damage as required by s 119 or s 269 because he lacked a personal proprietary interest in the causes of action (shares were held by the Official Assignee, guarantee had not been called, patent claim lacked factual foundation), the underlying claim was weak and inadequately evidenced, delay and non‑compliance caused real prejudice, and it was not fair or just to vest the disclaimed litigation rights in the applicant; accordingly leave to appeal was refused.
