The court dismissed all applications because there was a substantial unexplained delay in seeking leave to appeal, the respondents had suffered prejudice (notably an insurer settlement on a full and final basis), and the prospects of success on appeal were very low given the District Court's detailed factual findings that a binding telephone settlement was reached; allowing vesting or leave to adduce the alleged-fraud evidence would likely facilitate unmeritorious litigation and impose irrecoverable costs, so it was not in the interests of justice to grant relief.
