On the limited material before the Court the plaintiffs' initiation of summary judgment proceedings could not be characterised as an abuse of process; the plaintiffs took responsible steps by withdrawing the application once the defendants produced the evidence; accordingly the defendants' application for costs is declined at this stage and costs and disbursements associated with the withdrawn summary judgment application are reserved to follow the substantive proceedings.
