The court vacated the previously granted adjournment and brought the hearing forward because the unilateral share transfers occurring while an insolvency proposal was pending, combined with lack of frank disclosure, created a real and immediate risk to creditors and undermined confidence in undertakings; accordingly an earlier hearing was necessary to protect creditor and public interests and to allow the Official Assignee to proceed if necessary.
