The Assignee failed to discharge the onus of proving serious pre- or post-adjudication misconduct or concealment of beneficial interests sufficient to justify extending bankruptcy or imposing conditions; the Assignee's report contained assumptions and hearsay which were outweighed by direct and credible evidence from witnesses and professionals; accordingly the Court exercised its discretion to discharge the bankrupt without extension or conditions.
