Because the plaintiffs signalled early that they wished to discuss the claim and filed the discontinuance well before the defence filing date, and no defence had been filed, the court exercised its discretion under r14.1 and r15.23 to decline the Council's claim for costs; any award for preparatory work would have been small and was therefore not appropriate.
