The three month time limit in s.89(5) is mandatory and not subject to extension; the evidence did not prove non-compliance with s.67(2) on the balance of probabilities; accordingly the late review application could not be accepted and the appeal is dismissed.

Section 89(5) of the Accident Rehabilitation and Compensation Insurance Act 1992 contains a mandatory three‑month time limit for review requests and neither the Corporation nor the Court has discretion to extend that period; therefore the late application was correctly rejected and the appeal is dismissed.

The appeal is dismissed because the statutory transitional deadline (31 December 1992) precluded payment under the relevant provisions and there is no discretion in the Act or in the court to relax those statutory time limits, even though the facts might otherwise justify reimbursement or an ex gratia payment.
