Communications and correspondence from the without prejudice meeting of 18 November 2020 and subsequent communications to 11 December 2020 are privileged under s57(1); the trustees did not engage in unambiguous impropriety nor a dishonest purpose meeting the high thresholds of the exceptions (s57(3)(d) or s67), and privilege has not been waived; accordingly the application to disclose is dismissed and specified parts of the applicant's affidavit are struck out.
