The court held the costs claimed by the Commissioner were appropriate because they conformed to the Schedule of Fees Payable in the High Court Fees Regulations 2013 and Ms Chang's attendance was justified; Ms Hanson was ordered to pay specified costs and disbursements and the appeal remained dismissed for non-payment of security.

The defendant was entitled to costs and disbursements in the sum of $1,785 as calculated in the defendant's table, and the plaintiff must pay that sum within 21 days or the plaintiff's claim will be dismissed under Rule 258(2)(a).

Because the appellant refused to pay the mandatory setting down fee required by the High Court Fees Regulations and did not obtain a waiver, the court was entitled to treat the non-payment as abandonment and dismiss the appeal; an adjournment would be pointless and costs and interest were properly awarded to the respondent.
